1. Agreement to these terms

These Terms & Policies govern your use of the Texas Casual storefront and purchases from Texas Casual.

By affirmatively proceeding with checkout and placing an order, you agree to the version of these Terms & Policies presented or made available to you at the time of your transaction, to the fullest extent permitted by applicable law. If you do not agree, do not place an order.

Nothing in these Terms is intended to waive, limit, or exclude any consumer right, remedy, warranty, or protection that cannot lawfully be waived, limited, or excluded.

2. Terms version and electronic records

Each published version of these Terms & Policies may be identified by a version number and effective date. The version in effect when an order is placed will govern that transaction except where applicable law requires otherwise.

Later changes apply prospectively and do not retroactively replace the Terms applicable to an earlier transaction merely because the storefront Terms are later updated.

By placing an order electronically, you consent to conduct the transaction electronically and to receive transaction-related notices, confirmations, records, and communications electronically, subject to applicable law.

Texas Casual may maintain records reasonably necessary to document transactions, including order information, timestamps, payment and transaction identifiers, payment status, the applicable Terms version, and records relating to order acceptance, cancellation, fulfillment, refunds, fraud prevention, or disputes.

3. Order submission and acceptance

Submitting an order does not necessarily mean that Texas Casual has finally accepted the order for fulfillment. Texas Casual may review an order for payment, pricing, product or inventory availability, fulfillment availability, shipping information, suspected fraud or abuse, technical errors, or other legitimate operational concerns before releasing the order for fulfillment.

Texas Casual may refuse, limit, or cancel an order when reasonably necessary because of a payment problem, unavailable product, obvious pricing or technical error, suspected fraud, card testing, chargeback abuse, attempts to circumvent purchase limits, automated activity, harassment, threats, unlawful conduct, or interference with the storefront. Texas Casual will not exercise this right for an unlawful discriminatory reason.

4. Purchase limit

Texas Casual currently limits each order to a maximum of 3 items, including combinations of different products, sizes, colors, and variants.

Attempts to evade this limit through coordinated transactions, automation, or other abusive methods may result in cancellation or restrictions to the extent permitted by law.

5. Prices, taxes, and shipping charges

Product prices are displayed on the storefront. Applicable taxes and available shipping charges are calculated or presented during checkout. Texas Casual may correct an obvious pricing, product, or technical error before accepting an order.

Applicable taxes may be collected where required by law.

6. Payments and Stripe

Payments are processed through Stripe-hosted Checkout. Texas Casual does not directly collect or store customers' full payment-card numbers on its storefront servers. Stripe processes payment information under Stripe's own privacy, security, and data-processing practices.

Texas Casual may receive transaction identifiers, payment status, contact information, shipping information, and other limited transaction data needed to validate, fulfill, support, prevent fraud involving, and document an order.

7. Product fulfillment

Texas Casual offers both made-to-order and ready-made products. Depending on the product, an item may be produced after an order is accepted or fulfilled from available inventory.

Texas Casual generally holds newly placed orders for approximately one day before releasing them for fulfillment. This review period may be used for payment, product or inventory availability, fulfillment availability, shipping information, fraud or abuse prevention, technical issues, or other legitimate operational concerns.

Texas Casual works with third-party production, fulfillment, and shipping partners. After an order is released, a made-to-order product may enter production, while a ready-made product may be processed from available inventory. Fulfillment methods vary by product.

8. Cancellations and order changes

Customers should contact Texas Casual as soon as possible to request a cancellation or a change to an incorrectly selected size or color. Texas Casual generally holds newly placed orders for approximately one day before releasing them for fulfillment and will make reasonable efforts to accommodate requests received before fulfillment begins.

The approximately one-day review period is not a guarantee that an order can be changed or canceled. Once an order has been released for production, processing, or shipment through a fulfillment partner, Texas Casual may be unable to change or cancel it. A cancellation, refund, or other remedy required by applicable state or federal law will be provided regardless of this general policy.

9. Returns, exchanges, defects, and refunds

Texas Casual generally does not accept returns or exchanges for buyer's remorse, change of preference, or an incorrectly selected size or color. This policy applies to both made-to-order and ready-made products unless otherwise required by applicable law.

If a product arrives damaged, defective, misprinted, or materially different from the product ordered, contact us promptly with information reasonably necessary to evaluate the issue. Depending on the circumstances, the remedy may include replacement, reprint, refund, or another remedy required by law.

When Texas Casual approves or is legally required to issue a refund for a captured payment, Texas Casual will generally initiate the refund through the original payment transaction and original payment method within 1–2 business days.

Texas Casual generally will not substitute an unrelated payment method for an ordinary card refund when the original transaction can properly be refunded through the payment processor. After a refund is initiated, it may take approximately 5–10 business days for the credit to appear, depending on Stripe, payment networks, the customer's bank or card issuer, and the customer's payment method. In some cases, a recently completed payment may appear as a reversal rather than as a separate refund credit.

If a customer believes an expected refund has not arrived, the customer should contact Texas Casual so the transaction can be reviewed. Texas Casual may use available payment-processor records and transaction identifiers to investigate or assist with tracing the refund.

10. Shipping and delivery

Texas Casual currently accepts orders for delivery within the United States. Shipping options and charges are presented during checkout. Fulfillment time and carrier transit time are separate portions of the overall order-delivery process.

Orders commonly arrive within approximately 1–3 weeks from the date the order is placed, and many may arrive sooner. This is an estimated overall timeframe and is not a guaranteed delivery date.

Texas Casual generally holds newly placed orders for approximately one day before releasing them for fulfillment. After release, fulfillment and delivery times may vary based on the product's fulfillment method, product or inventory availability, fulfillment location, production conditions when applicable, destination, carrier conditions, and the shipping method selected at checkout.

Shipping estimates presented during checkout describe estimated carrier transit time and do not represent the entire period from order placement through fulfillment and delivery. Production when applicable, processing, weekends, holidays, inventory availability, quality-control issues or reprints, weather, carrier delays, and other circumstances may increase the total delivery time.

Any fulfillment, production, shipping, or delivery estimate is an estimate unless Texas Casual expressly represents otherwise.

Customers are responsible for providing a complete and accurate shipping address. Reasonable additional costs resulting from an incorrect or incomplete address supplied by the customer may be the customer's responsibility to the extent permitted by law.

If Texas Casual cannot ship within a promised or legally required period, Texas Casual will provide any delay notice, opportunity to consent to the delay, cancellation option, or refund required by applicable law.

11. Fraud, abuse, and store security

Texas Casual may use reasonable safeguards to protect customers and the business, including purchase limits, rate limiting, payment verification, fraud screening, duplicate-order controls, and manual order review.

Texas Casual may restrict access, decline transactions, cancel orders, or refuse future transactions when reasonably necessary to address suspected fraud, stolen-payment activity, card testing, chargeback abuse, automated attacks, attempts to circumvent purchase limits, harassment, threats, unlawful conduct, or attempts to interfere with the storefront or its systems, subject to applicable law.

12. Fulfillment and service providers

Texas Casual may use third-party providers to operate the storefront, process payments, calculate applicable taxes, produce made-to-order merchandise, fulfill ready-made merchandise from available inventory, ship and deliver orders, prevent fraud, provide hosting, and perform related business functions.

Information reasonably necessary to perform these services may be provided to those service providers as described in the Texas Casual Privacy Notice. Use of a service provider does not eliminate rights or obligations that applicable law places upon Texas Casual in its relationship with the customer.

13. Intellectual property

Texas Casual branding, original artwork, graphics, storefront content, page designs, text, and other protected materials may not be copied, reproduced, distributed, or commercially exploited without authorization except as permitted by applicable law.

Purchasing a physical Texas Casual product does not transfer intellectual-property ownership in the underlying artwork, branding, or design.

14. Limitation of liability

To the fullest extent permitted by applicable law, Texas Casual will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the storefront or a transaction.

Nothing in these Terms excludes or limits liability, consumer remedies, warranties, or other rights to the extent such exclusion or limitation is prohibited by applicable law.

15. Governing law

To the fullest extent permitted by applicable law, these Terms & Policies and disputes arising out of or relating to these Terms, the Texas Casual storefront, or transactions with Texas Casual will be governed by the laws of the State of Texas, without regard to conflict-of-laws principles.

Nothing in this provision is intended to deprive a consumer of a protection that applicable law does not permit the consumer to waive by agreement.

16. Forum and jurisdiction

To the fullest extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms & Policies, the Texas Casual storefront, or a transaction with Texas Casual shall be brought in an appropriate state or federal court located in the State of Texas. By entering into a transaction with Texas Casual, each party consents to the personal jurisdiction of such courts for such disputes.

This provision does not require a dispute to be brought in a particular Texas county where applicable law does not permit such a contractual venue requirement, and it does not waive any jurisdictional, venue, consumer-protection, or other right that cannot lawfully be waived.

17. Non-waivable rights

Nothing in these Terms & Policies is intended to waive, restrict, disclaim, or eliminate any consumer protection, statutory right, remedy, warranty, jurisdictional protection, or other legal right that applicable law does not permit the parties to waive or limit by agreement.

If applicable law conflicts with a provision of these Terms in circumstances where that law cannot lawfully be altered by agreement, the applicable law controls to the extent of that conflict.

18. Severability

If a court or other tribunal with authority determines that a provision of these Terms is invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed, while the remaining provisions continue in effect to the extent permitted by law.

19. Changes to these terms

Texas Casual may update these Terms & Policies prospectively. Each published version may carry a new version number and effective date. Unless applicable law requires otherwise, an update will not retroactively replace the Terms applicable to a transaction completed under an earlier version.
